2. Collection and storage of personal data and the type and purpose of their use when visiting the website

When you visit our website www.biomindz.com, information is automatically sent to our website server by the browser used on your end device. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

Anonymised IP address, country of origin, provider, browser incl. plugins, page of origin, pages visited, time of visit, duration of visit and screen resolution.
The above data will be processed by us for the following purposes:

  • Ensuring a smooth connection of the website,
  • Ensuring a comfortable use of our website,
  • evaluation of system security and stability, and
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

In addition, we use cookies and analysis services when you visit our website. You can find more detailed explanations on this under point 4 of this data protection declaration.

3. Cookies

We use cookies on our site. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans or other malware.

Information is stored in the cookie that is related to the specific end device used. However, this does not mean that we gain direct knowledge of your identity.

The use of cookies serves, on the one hand, to make the use of our offer more pleasant for you. We use so-called session cookies to recognise that you have already visited individual pages of our website. These are automatically deleted after you leave our site. In addition, we also use temporary cookies to optimise user-friendliness, which are stored on your end device for a certain fixed period of time. If you visit our site again to use our services, it is automatically recognised that you have already been to our site and which entries and settings you have made so that you do not have to enter them again.

On the other hand, we use cookies to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you (see point 5). These cookies enable us to automatically recognise that you have already been to our website when you visit it again. These cookies are automatically deleted after a defined period of time. The data processed by cookies is necessary for the aforementioned purposes to protect our legitimate interests as well as those of third parties in accordance with Art. 6 (1) p. 1 lit. f DSGVO.

Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a notice always appears before a new cookie is created. However, the complete deactivation of cookies may mean that you cannot use all the functions of our website.

4. Tracking measure by Google Analytics

If you have given your consent, this website uses Google Analytics, a web analytics service provided by Google LLC. The responsible entity for users in the EU/EEA and Switzerland is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").

Scope of the processing
Google Analytics uses cookies that enable an analysis of your use of our website. The information collected by means of the cookies about your use of this website is usually transferred to a Google server in the USA and stored there.

For Google Analytics, the anonymisation of IP addresses is activated by default. Due to IP anonymisation, your IP address is shortened by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. According to Google, the IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. 

During your website visit, your user behaviour is recorded in the form of "events". Events can be:

  • Scrolls (whenever a user scrolls to the bottom of the page (90%))

Purposes of the processing
On behalf of the operator of this website, Google will use this information for the purpose of evaluating your anonymous use of the website and compiling reports on website activity. The reports provided by Google Analytics are used to analyse the performance of our website.

It cannot be ruled out that US authorities will access the data stored by Google.

Third country transfer

Insofar as data is processed outside the EU/EEA and there is no level of data protection corresponding to the European standard, we have concluded EU standard contractual clauses with the service provider to establish an appropriate level of data protection. The parent company of Google Ireland, Google LLC, is based in California, USA. A transfer of data to the USA and access by US authorities to the data stored by Google cannot be ruled out. The USA is currently considered a third country from a data protection perspective. You do not have the same rights there as within the EU/EEA. You may not have any legal remedies against access by authorities.

Storage period

The data sent by us and linked to cookies are automatically deleted after 2 months. The deletion of data whose retention period has been reached takes place automatically once a month.

Legal basis

The legal basis for this data processing is your consent pursuant to Art. 6 Para. 1 Sentence 1 lit. a DSGVO [IF ONLY: Art. 49a DSGVO].

Revocation

You can revoke your consent at any time with effect for the future by calling up the cookie settings and changing your selection there. The lawfulness of the processing carried out on the basis of the consent until revocation remains unaffected.
You can also prevent the storage of cookies from the outset by configuring your browser software accordingly. However, if you configure your browser to reject all cookies, this may restrict functionalities on this and other websites. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google and the processing of this data by Google by selecting the appropriate settings on your browser:

a.    do not give your consent to the setting of the cookie or
b.    download and install the browser add-on to disable Google Analytics HERE.

5. Integration of social media services and other third-party content

Within our online offer, we use content or service offers from social media service providers and other third-party providers on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer) in order to integrate their content and services, such as videos (hereinafter uniformly referred to as "content"). This always requires that the third-party providers of this content are aware of the IP address of the user, as without the IP address they would not be able to send the content to their browser. The IP address is thus necessary for the display of this content.

In doing so, we ensure that data transmission only takes place when you use these services.  

Unless otherwise stated below, the legal basis for the transmission of your data is Art. 6 para. 1 p. 1 lit. f DSGVO. 

The following presentation provides an overview of third-party providers and their content, along with links to their data protection declarations, which contain further information on the processing of data and, in part already mentioned here, options for objection (so-called opt-out).

Please note that an adequate level of data protection cannot currently be guaranteed for the social media providers from the USA listed below.

a) YouTube:

This website uses the so-called "extended data protection mode" of the provider YouTube to integrate videos. This means that a cookie is only saved on your computer when the video is played. According to YouTube, however, no personal cookie information is stored for playbacks of embedded videos with extended data protection. When you click on the video, data is sent to YouTube over which we have no control. 
By activating the video, you consent to the collection, processing and use of the data collected and entered by Google, one of its representatives or third-party providers (consent pursuant to Art. 6 para. 1 sentence 1 lit. a DSGVO).

b) LinkedIn:

Employees of biomindz maintain online presences on linkedIn.com, to which we refer on our website.

For this purpose, we use the services of the technical platform of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland (hereinafter: LinkedIn). When you select the online presences on LinkedIn, at least your IP address is transmitted to LinkedIn.

We point out that you use the service offered via LinkedIn and its functionalities on your own responsibility. This applies in particular to the use of interactive functions, such as sharing.

LinkedIn alone is responsible for the processing of personal data when you visit our LinkedIn pages. Further information on the processing of personal data by LinkedIn can be found at

Please note that according to the LinkedIn Privacy Policy, personal data is also processed by LinkedIn in the USA or other third countries. According to LinkedIn, it only transfers personal data to countries for which the European Commission has issued an adequacy decision pursuant to Article 45 of the GDPR or on the basis of appropriate guarantees pursuant to Article 46 of the GDPR.

6. Betroffenenrechte

You have the right:

  • pursuant to Art. 15 DSGVO to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details;
  • in accordance with Art. 16 DSGVO to demand the correction of incorrect or completion of your personal data stored by us without delay;
  • in accordance with Art. 17 DSGVO to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;
  • in accordance with Art. 18 DSGVO to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it to assert, exercise or defend legal claims or you have objected to the processing in accordance with Art. 21 DSGVO;
  • pursuant to Art. 20 DSGVO to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller;
  • in accordance with Art. 7 (3) DSGVO to revoke your consent at any time. This has the consequence that we may no longer continue the data processing based on this consent for the future, and
  • pursuant to Art. 77 DSGVO to complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our registered office.

7. Right to object (to advertising)

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) sentence 1 lit. f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, provided that there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.
